Appropriate Adults and 17 year olds

The High Court yesterday ruled that 17 year olds in Police custody should be offered an appropriate adult following a finding that a failing to revise PACE Codes C to distinguish between 17 year olds and adults, the government were in breach of obligations under the Human Rights Act 1998 and was therefore acting unlawfully.

Following this decision The Association of Chief Police Officers has therefore issued guidance to Police forces that with immediate effect Forces should offer the services of an appropriate adult to all 17 year olds.

They further stated that it is however important to note that an appropriate adult can only be provided with the consent of the 17 year old.
