Company Law v. Family Law in Divorce Cases

The Supreme Court is to decide whether spouses can protect assets behind the corporate veil of a company, citing company law.

Last year the Court appeal held in a two to one majority in favour of the Husband who successfully argued that the company assets could not be seized because the firm was a separate legal entity.

The Wife has since lodged an appeal with the Supreme Court, with the matter listed for two day hearing starting today. The issue will be determined by seven Justices of the Supreme Court.
