Metal Theft Powers

The Home Office have announced that new powers will come into force on 3rd December 2012 to tackle metal theft.

An offence under S145 of the Legal Aid, Sentencing and Punishment of Offenders Act 2012 will be created of buying scrap metal for cash. This will punishable by a fine of up to £5,000.

Police are also to receive greater powers to enter and inspect the premises of scrap metal dealers suspected of accepting cash payments.

Section 146 of the Legal Aid, Sentencing and Punishment of Offenders Act 2012 will increase the fines under the Scrap Metal Dealers Act 1964 for existing offences relating to the administration of scrap metal dealerships. The current maximum fine of £1,000 will be raised to £5,000.
